Paying the bond does not guarantee the issuance of a visa. If the applicant is denied, the bond must be refunded. The money is also returned after the timely departure of the traveler from the U.S. and compliance with all conditions of stay. In case of a visa regime violation, the bond may be confiscated. The program primarily affects countries with a high level of overstaying in the U.S. Most of the countries on the list are located in Africa, but there are also countries from Asia, Latin America, and some former USSR republics - Georgia, Kyrgyzstan, Tajikistan, and Turkmenistan. U.S. authorities explain the measure as an effort to reduce the number of foreigners who remain in the country after their permitted stay has expired. Human rights advocates and migration specialists criticize the program. In their opinion, the bond effectively closes the possibility of travel to the U.S. for many low-income individuals, even if they plan a legal short-term visit. Critics also fear that the new rules may lead to discrimination against applicants based on nationality or financial status. The State Department will be able to review the list of countries whose citizens are affected by the requirement and add new countries to it.
