Justice Minister Edvards Smiltens stated that Latvia needs to define the legal boundaries of state intervention in the activities of capital companies. He said this during the broadcast of the program "Morning Panorama." According to the minister, the question remains open as to whether the government has the right to intervene in decisions that, by law, fall within the competence of the management of capital companies. He called this topic one of the key issues for public administration. The discussion was prompted by situations surrounding the national airline airBaltic, as well as the companies Tet and Latvijas mobilais telefons. It is in connection with these enterprises that questions about the role of the state as an owner have been actively discussed recently. In Smiltens' opinion, there are cases where non-intervention can harm the interests of the country. As examples, he cited situations where the actions of a company's management contradict the interests of the state and can affect the economy, national security, or other important areas. This is not about the day-to-day management of enterprises, but about finding a balance between the autonomy of capital companies and the responsibility of the state as the owner of strategically important assets. The minister believes that it is necessary to define clear criteria that will allow understanding where the government's right to intervene in the activities of companies ends, and where such intervention becomes justified in the interests of the state. According to him, various options for solutions are currently being analyzed by lawyers. Among the possibilities being considered is an appeal to the Constitutional Court, which could provide a legal assessment of the existing regulation. Thus, the discussion may lead to a clearer delineation of the powers of the government and the management of state enterprises, especially in cases where it concerns companies that are strategically important for the country.
